American Recovery and Reinvestment Act of 2009
(ARRA)
On February 17, 2009, President Obama signed the
American Recovery and Reinvestment Act of 2009
(ARRA). The stimulus package appropriated $4.5
billion in funding for two smart grid grant programs
authorized by the Energy Independence and Security
Act of 2007 (EISA). In October and November 2009,
respectively, the Department of Energy used the
funds to award $3.4 billion in Smart Grid Investment
Grants and $620 million in Smart Grid Demonstration
Grants.

Emergency Economic Stabilization Act of 2008
On October 3, 2008, President Bush signed the
Emergency Economic Stabilization Act of 2008, which
includes a provision to accelerate the depreciation
rate for smart meters and smart grid systems. Any
qualifying device placed in service after October 3,
2008, now may depreciate over a ten-year period
instead of a 20-year period.

The Energy Independence and Security Act of 2007
On December 19, 2007, President Bush signed the
Energy Independence and Security Act of 2007 (EISA).
The act includes an entire title on the smart grid
(Title XIII) as well as a directive for the Federal
Energy Regulatory Commission (FERC) to develop a
National Action Plan on Demand Response within 18
months.

Energy
Policy Act of 2006: Section 1252 (EPACT)
On August 8, 2005, President Bush signed into
law the Energy Policy Act of 2006 (EPACT). Section
1252 of the Electricity Section of EPACT is Titled
“Smart Metering” and it includes new requirements on
States, DOE and FERC with respect to Demand Response
and Advanced Metering.
